Terms of Use

Welcome to Swipii!

These Terms of Use govern your use of the Swipii Services. When you register a Swipii account, download our mobile application (app) or use our website, you agree to these Terms of Use.

 

These Terms of Use refer to the following additional terms, which also apply to your use of our app or website:

You should read these Terms of Use, Swipii’s Website Terms & Conditions and Swipii’s Privacy Policy carefully. If you are not happy with these terms, please do not download our App or use our website.

 

Definitions

In these Terms of Use, Swipii Labs Ltd is referred to as “Swipii” (collectively referred to us “we”, “us” or “our”).

We refer to our Swipii users as a “user” (collectively referred to as “you”, “your” or “users”).

Our partner businesses (who provide you with Swipii loyalty points for purchasing their goods and services) are referred to as “Merchant” or “Merchants”.

All loyalty points collected from participating Merchants are referred to as “points”.

The service Swipii provides, as detailed below, are referred to as “the Service”.

 

The Service

These Terms of Use apply to your use of the Service operated by Swipii.  The Service includes the use of our mobile app, website and software. The Service can be used to obtain and redeem loyalty points with participating Merchants. These points are processed through our database using software installed at Swipii’s offices. You can access the points you have collected, as well as viewing the various promotional offers available to you, via our website and app.

 

The Privacy Policy

As part of providing the Service, we collect and use your personal information. Swipii’s Privacy Policy explains how we use this data to provide you with the Service. It also explains your rights in relation to data privacy and processing. We will only use your personal information as set out in our Privacy Policy.

User commitments

In exchange for our provision of the Service, we require you to make the following commitments to us as a Swipii user:

  • You must not create a Swipii account if we have previously deactivated your account for violating the law or for breaching any of our policies (e.g. our Website Terms & Conditions);
  • If you choose, or are provided with, a username, password or other piece of information as part of our security procedures, you must treat such information as confidential and must not disclose these details to a third-party; and
  • You must be at least 16 years old. The Service is not intended for use by persons under the age of 16.

 

Our responsibility for loss or damage suffered by you

You acknowledge that the Service is being made available to you free of charge and that Swipii makes no representations or warranties, express or implied, regarding the Service. All representations, undertakings, warranties, terms and conditions, whether express or implied by statute, common law or otherwise are excluded to the fullest extent permitted by law. Except as provided in these Terms of Use, Swipii shall not be liable to your for any claims whatsoever including but not limited to those arising from loss of profits, business, revenue, goodwill, anticipated savings and/or any other indirect, special or consequential loss whether arising under contract, negligence or otherwise out of or in connection with the Service. In particular, Swipii accepts no responsibility or liability for the acts or omissions of participating Merchants which operate independently of Swipii. Swipii neither excludes nor limits its liability for death or personal injury caused by its own negligence or any other liability the exclusion or limitation of which is expressly prohibited by law.

 

Who you have contracted with

Your contract regarding the redemption of points from Merchants, and the provision of goods and services which can be obtained by points from Merchants, is with the Merchant who has issued the points – It is NOT with Swipii. Accordingly, Swipii is not responsible for any failure by a Merchant to provide goods and services in return for points that you may have accumulated.

 

Loyalty Cashback

We are currently trialling a new cashback feature at some of our Swipii locations. We are testing this to see if our customers and businesses prefer cashback as opposed to a traditional reward. 

Please be aware that these Terms and Conditions may change from time to time during the trial.

  1. Cashback works the same as rewards, when you make a purchase in a Swipii participating location you will be awarded points for your purchase based on your spend. When you meet the business’ reward value, you can redeem in the form of the current reward offered,  or convert your points to cash. The cash will be held in a Wallet within the Swipii app until you are able to withdraw your cash. You can find out more about the withdrawal process and conditions below.
  2. Cashback will only be paid into your Wallet when you meet the following criteria:
    1. You have a valid account with Swipii on the Swipii app
    2. You have registered one or more debit or credit cards to your account
    3. You make a qualifying purchase(s) in one of our Swipii locations on the app offering cashback, using one of your registered debit or credit cards
    4. You meet the first reward value and click on the Claim Cash button
    5. You must have registered your bank details in the app in order to receive cashback
  3. Once you have claimed your cashback you will see the transaction as “Pending” in your Wallet. When the business you have shopped with transfers us the cashback to add to your account, the cashback will appear as “Available” in your Wallet. This can take up to 30 days. 
  4. We reserve the right to reclaim or adjust any Cashback payments in the event that any Cashback has been added to your Wallet in error. 
  5. Cashback is only available from participating Swipii locations.
  6. We reserve the right to end cashback as a reward feature at any time. 
  7. We do not hold money in your Swipii allet as a bank would, and legal title to any cashback earnings does not pass to you until you have taken possession of the cashback by way of a successful withdrawal from your Swipii Wallet.
  8. You agree and acknowledge that in all circumstances the payment of cashback and rewards to you is at our discretion and we may refuse to pay Cashback to you for any reason.

 

Deals Cashback

We have introduced a new feature to the Swipii app, Swipii Deals. Deals will be live in the Swipii app from the 27th of October 2019. Depending on the Deal, users will get a set amount of cashback in return for spending a specified amount at a Swipii participating business during a designated time period.

  1. By Activating a Deal on the Swipii app, you are agreeing to visit an individual merchant to receive the cashback benefits as stipulated in the Terms and Conditions of each Deal. The Deal you Activate is only applicable for the Merchant stipulated in the Deal. 
  2. You are required to create an account with Swipii and link your card in order to Activate any Deal. All Deals shall be subject to the individual Terms and Conditions of Swipii and the participating Merchant as well as those stipulated within each Deal. 
  3. It is at the users’ discretion to Activate the desired Deals and visit the participating Merchant. Deals expire on the date and time specified on the Deal itself.
  4. Cashback will only be allocated when a user makes a purchase which meets the minimum spend stipulated within the Deal within a single transaction. 
  5. Cashback earned by Activating a Deal and making a qualifying purchase will be sent to the users’ Wallet within the Swipii app and shown as Pending, with the cash available to withdraw once the user has passed the minimum withdrawal threshold. 
  6. We receive a commission payment from the locations on the Swipii app for each qualifying purchase that you make with them. If we do not receive the Swipii Commission Fee from the relevant store for a qualifying purchase, we will not be liable to pay the corresponding cashback to you.
  7. Once the Swipii Location pays the Swipii Commission Fee to us (which can take 30 days or more from the date of the qualifying purchase), the cashback will be shown as “Available” in your Wallet.
  8. Once you have claimed the cashback in relation to your qualifying purchase, the status will change to Withdrawn, and the corresponding amount will be deducted from your “Available Cashback” balance and transferred to your bank account.
  9. It is at the discretion of the Merchant to determine whether Deals can be combined with any other Swipii benefits such as Loyalty cashback or Referrals.
  10. The Merchant, and Swipii, reserve the right to withdraw a Deal at any point and are not required to give a reason for such. Neither the Merchant nor Swipii takes responsibility for any Expired Deals which have not been used before the Deal period expires. 
  11. The images used for each Deal on the Swipii app are for illustrative purposes only. 

 

Cashback Withdrawal

TO BE ABSOLUTELY CLEAR, THE “AVAILABLE CASHBACK” BALANCE DOES NOT REPRESENT A SUM OF MONEY HELD BY US ON YOUR BEHALF.

You can submit a request to withdraw cashback at any time, providing the Available Cashback section of the Wallet has a value greater than £2. The minimum withdrawal amount is subject to change at any time. 

You may only request one payout option in any 24 hour period.

You may withdraw your cash from your Wallet by BACS. Payout methods may stipulate a minimum value threshold being reached before allowing you to withdraw your cashback. 

It is your responsibility to ensure your correct payout details are submitted. We shall not be responsible for any Payable Cashback being sent to an incorrect destination where you have provided incorrect details. 

The time between requesting payment of your Payable Cashback and it being credited to your chosen payout method within 5-10 working days. We shall not be liable for any delays.

We reserve the right to suspend Payable Cashback payments at any time without notice to you if we reasonably suspect fraudulent activity has taken place.

 

Referral 

We are currently trialling a new referral feature with some of our Swipii locations. We are testing this to see if our customers would benefit from being able to refer their friends to their favourite Swipii participating businesses. You can find out more about how the referral feature works here

  1. By referring a friend to the Swipii app, or by using a referral link to the Swipii app, you are entering into an agreement between the Swipii participating business and yourself. Swipii is a mediator for this agreement to take place.
  2. In order to gain the bonus points and/or free reward for the referral, the party being referred to the app must link their card to their account and make a verified purchase in the participating Swipii location. 
  3. Each party involved, the ‘referrer’ and the ‘referree’, will be compensated with the given bonus points and/or free reward which is stipulated on the participating business’ listing within the Swipii app. 
  4. We reserve the right to withdraw the referral feature at any time. 
  5. The business being referred reserves the right to alter, amend or cancel their referral offers at any time, therefore it is the referree’s responsibility to use the referral offer in a timely manner. 

 

Terminating your account

Swipii reserves the right to terminate the Service and/or your use of the Service at our discretion and without notice.

 

Third-Party Rights

Third parties do not have any rights under these Terms of Use.  You cannot assign your rights or obligations which arise from these Terms of Use without our express written consent.  

 

Changes to these Terms of Use

We may update or amend these Terms of Use from time to time. In most cases, we will give you at least 30 days notice prior to making any changes. This will give you time to review any changes to make sure you’re happy with them before they go into effect. If you continue to use the Service after this timeframe, you will be bound by the updated Terms of Use.

 

Which country’s laws apply to disputes

Please note that these Terms of Use, their subject matter and their formation, are governed by Scottish Law and are subject to the non-exclusive jurisdiction of the Scottish Courts.
