Welcome to Swipii!

These Terms of Use govern your use of the Swipii Services. When you register a Swipii account, download our mobile application (app) or use our website, you agree to these Terms of Use.

These Terms of Use refer to the following additional terms, which also apply to your use of our app or website:

You should read these Terms of Use, Swipii’s Website Terms & Conditions and Swipii’s Privacy Policy carefully. If you are not happy with these terms, please do not download our App or use our website.

Definitions

In these Terms of Use, Swipii Labs Ltd is referred to as “Swipii” (collectively referred to as “we”, “us” or “our”).

We refer to our Swipii users as a “user” (collectively referred to as “you”, “your” or “users”).

Our partner businesses (who provide you with cashback for purchasing their goods and services) are referred to as “Merchant” or “Merchants”. 

The service Swipii provides, as detailed below, is referred to as “the Service”.

The Service

These Terms of Use apply to your use of the Service operated by Swipii. The Service includes the use of our mobile app, website and software. The Service can be used to obtain and redeem cashback with Merchants.

The Privacy Policy

As part of providing the Service, we collect and use your personal information. Swipii’s Privacy Policy explains how we use this data to provide you with the Service. It also explains your rights in relation to data privacy and processing. We will only use your personal information as set out in our Privacy Policy.

User commitments

In exchange for our provision of the Service, we require you to make the following commitments to us as a Swipii user:

Our responsibility for loss or damage suffered by you

You acknowledge that the Service is being made available to you free of charge and that Swipii makes no representations or warranties, express or implied, regarding the Service. All representations, undertakings, warranties, terms and conditions, whether express or implied by statute, common law or otherwise are excluded to the fullest extent permitted by law. Except as provided in these Terms of Use, Swipii shall not be liable to your for any claims whatsoever including but not limited to those arising from loss of profits, business, revenue, goodwill, anticipated savings and/or any other indirect, special or consequential loss whether arising under contract, negligence or otherwise out of or in connection with the Service. In particular, Swipii accepts no responsibility or liability for the acts or omissions of participating Merchants which operate independently of Swipii. Swipii neither excludes nor limits its liability for death or personal injury caused by its own negligence or any other liability the exclusion or limitation of which is expressly prohibited by law.

Who you have contracted with

Your contract is with the Merchant who has issued the cashback – It is NOT with Swipii. 

Earning Cashback

With the Swipii app, you earn cashback every time you make a purchase with a Swipii Merchant.

Types of Cashback Offers:

Always on Cashback Offers
This is the cashback amount which users are able to redeem anytime provided they meet the criteria given in the above section ‘Earning Cashback’, and that there isn’t an Extra Cashback Offer which they’re eligible for at the time of redemption.

Extra Cashback Offers
These are campaigns set up by Merchants to allow users to receive a higher amount of cashback than the Merchant’s standard ‘Always on’ amount when the user redeems against a campaign that they’re eligible for. Unlike ‘Always on’ cashback offers, Extra Cashback Offers are subject to particular parameters. There are two types of Extra Cashback Offers, Scheduled Offers and Personalised Offers.

Scheduled Offers
Scheduled Offers are time-bound offers available to all users.

Personalised Offers
Personalised Offers which are available to specific users who meet its target parameters. Win-Back Offers are a type of Personalised Offer.

Win-Back Offers
Win-Back Offers are Personalised Offers which are designed to target users who haven’t transacted with a linked card at a Merchant from a period of time.

Cashback withdrawal

To be absolutely clear, the "available cashback" balance does not represent a sum of money held by us on your behalf.

You can submit a request to withdraw cashback at any time, providing the Available Cashback balance has a value greater than £2. The minimum withdrawal amount is subject to change at any time. 

You may only request one payout option in any 24 hour period.

You may withdraw your cash from your "Balance" by providing your bank account details in the app. Payout methods may stipulate a minimum value threshold being reached before allowing you to withdraw your cashback. 

It is your responsibility to ensure your correct payout details are submitted. We shall not be responsible for any Payable Cashback being sent to an incorrect destination where you have provided incorrect details. 

The time between requesting payment of your Payable Cashback and it being credited to your chosen payout method within 5-10 working days. We shall not be liable for any delays.

We reserve the right to suspend Payable Cashback payments at any time without notice to you if we reasonably suspect fraudulent activity has taken place.

Referral

Referring a friend is a great way to share Swipii and encourage your friends to support local businesses. As with everything, there are some guidelines in place so that it’s all fair and sustainable. Here’s all the necessary info:

What is the referral reward?

If the referee installs the app and makes their first purchase with their linked card, both the referee and the referrer will receive bonus cashback of an amount advertised by Swipii from time to time.

This cashback will be applied to your "Balance", available to withdraw to a bank of your choice when you hit the minimal withdrawal threshold.

When the referee makes the qualifying purchase, Swipii will notify both referrer and referee that the bonus cashback has been allocated to each of their "Balances". 

General referral information

We handle and use all customer information as set out in our Privacy Policy.

We reserve the right to vary these terms and conditions and to terminate the scheme at any time. It is your responsibility to remain informed as to any changes via these pages and our normal channels of communication.

By taking part in the scheme you understand that we continuously monitor participation and will take action against suspected abusive or fraudulent activity.

Closing your account

Please also refer to our Privacy Policy for how we use and process your personal information. You may close your Swipii account at any time by emailing hello@swipiicard.com quoting the email address registered to your account. We will then close your account in accordance with our Privacy Policy within 28 days. If you have more than the minimum £2 withdrawal threshold in your "Balance" at the time of your request, our Customer Service Team will attempt to contact you once in order to ask you to make your final withdrawal. On the expiry of 28 days, your account will be closed and all data will be deleted, including your "Balance".

Terminating your account

Swipii reserves the right to terminate the Service and/or your use of the Service at our discretion and without notice.

Third-Party Rights

Third parties do not have any rights under these Terms of Use.  You cannot assign your rights or obligations which arise from these Terms of Use without our express written consent.  

Changes to these Terms of Use

We may update or amend these Terms of Use from time to time. In most cases, we will give you at least 30 days notice prior to making any changes. This will give you time to review any changes to make sure you’re happy with them before they go into effect. If you continue to use the Service after this timeframe, you will be bound by the updated Terms of Use.

Which country’s laws apply to disputes

Please note that these Terms of Use, their subject matter and their formation, are governed by Scottish Law and are subject to the non-exclusive jurisdiction of the Scottish Courts.
